Hearing involving county councilman, partner will be held at a later date A hearing scheduled for Wednesday involving Carolina Collision owners Tim Parker and Tim Spencer has been continued. The hearing at the Cherokee County Courthouse had been scheduled regarding a motion for a temporary injunction against Spencer, a Cherokee County councilman. Parker is asking that Spencer, his business partner, be restrained "from withdrawing funds of Carolina Collision Inc., Carolina Collision Partnership, Carolina Collision Wrecker Service Inc., and Carolina Collision Center of Shelby Inc. until a full accounting is made and payment of all sums due Parker are received." Spencer began the legal battle involving the two when he filed litigation against Parker stating he and Parker cannot work together amicably and the work environment is damaging the businesses economically. Parker responded to the suit by filing a counterclaim and requesting the injunction. Parker's counterclaim states that Spencer "has never created files for the accounting of payments to be made incident to certain paint jobs where time was reported by painters... (and) has engaged in selfdealing and other fraudulent activity." The counterclaim states that Spencer has been taking the majority of the profits in the equally owned businesses and has issued 88 bad checks in the name of the companies. Parker also claims bills have not been paid and that Spencer has instructed the companies to enter into illegal and fraudulent transactions and to file unlawful and fraudulent reports. Parker wanted Spencer to buy his portion of the business from him. In his suit, he is asking for dissolution and liquidation of the companies and for judgment against Spencer individually. He is also asking for punitive and actual damages. |
