Developer hopes board will approve variance request

A developer plans to build two large apartment and patio home developments. But that might change if the Cherokee County Board of Appeals abides by a recommendation to deny the developers' variance request.

CDS Development Co. LLC wants to build a development that includes 179 patio homes and 155 apartment units on a 60-acre lot owned by Henry and Michelle Jolly on Pacolet Highway.

The same developer also plans to build 264 patio homes and a 252- apartment complex on a 67-acre site that fronts Lockhart Lane. Roger Kent LLC is the owner of that property.

But before the developments can move forward the developer must obtain a variance from the Cherokee County Board of Appeals since the proposed 6,000-square foot patio home lots at both locations fail to meet the 7,000 squarefoot minimum lot size required by the county's land development regulations.

Appalachian Council of Governments planner Chip Bentley has recommended the appeals board deny the variances because the developer fails to establish the existence of a unique physical feature that would create a hardship for the developer.

The appeals board will hear the variance request on Thursday.
