Mall sues former tenant

Owners of Prime Outlets — Gaffney filed suit in the Cherokee County Clerk of Courts Office on Tuesday against a former tenant for what the suit claims is breach of a rental agreement.

Gaffney Outlets LLC., is seeking $25,926 from Cash Farms Inc., doing business as Yum-Yums, claiming the tenant failed to pay rent.

According to the lawsuit and a copy of the agreement, Gaffney Outlets and Cash Farms Inc. entered into a rental agreement on June 18, 2007 for the lease of 626- square-feet of space in the food court at Prime Outlets.

The rental agreement, which was set to expire May 31, 2008, was to cost $42,000 overall, or $3,500 a month. The lawsuit states Gaffney Outlets terminated the agreement Dec. 23, 2007 due to Cash Farms Inc.'s failure to pay rent.
