Woman ordered to wear monitoring device
A southern Cherokee County woman facing a murder charge will have to wear an electronic monitoring device in the wake of her recent citation for driving under the influence while she was supposed to be on home confinement.
Wanda Denise Brown, 36, of Grindall Ford Road, was cited for a second offense of DUI and for driving under suspension following a 5:15 a.m., Feb. 14 traffic stop in the city.
Police said in a report that Brown failed field sobriety tests after the stop yet had a zero percent blood alcohol content during a subsequent breath test, leading them to take her to Upstate Carolina Medical Center for a body fluid sample that will be sent to the South Carolina Law Enforcement Division for more testing.
At the time of the Feb. 14 traffic stop, Brown already was out on $30,000 bond on a murder charge in connection with the Oct. 5, 2008, shooting death of 53-year-old Richard Bryant, of Spartanburg, inside her former address on Sharon Road. A condition of her bond on the murder charge, as set by Circuit Court Judge Paul Burch last Oct. 29, was that she would be under house arrest from 7 p.m. to 7 a.m. unless at work, court records show.
The 7th Circuit Solicitor's Office alleged the latest incident was a violation of Brown's bond on the murder charge and asked Circuit Court Judge Mark Hayes on Friday to revoke the bond.
Brown's lawyer, Albert Smith, argued Brown was returning from a job when she was stopped and that her bond shouldn't be revoked without any test results from the DUI stop in hand.
Judge Hayes decided not to revoke Brown's bond altogether but did decide to place her on electronic monitoring so her movements can be tracked.
Court records show that Brown's bonding company previously sought court approval to withdraw as her bond agency but nothing ever became of the company's motion.
Brown's lawyer said in court he would be pursuing a self-defense claim on the murder charge.
