Judge: Police had probable cause to issue arrest warrant

A lawyer for a 48-year-old Gaffney man contended Wednesday in Gaffney Municipal Court that police did not have enough evidence to arrest his client for a Feb. 8 incident during which a woman's vehicle was struck several times by shotgun blasts.

Terry Wood Sr., of Concord Heights Road, is accused of assault and battery with intent to kill in connection with the incident. Gaffney police allege Wood fired several shots from a shotgun at a woman's car on Smith Street.

The back window of the woman's vehicle was shattered and one projectile allegedly tore through the driver's seat and struck the woman in the shoulder. Wood and the woman were known to each other.

Following a preliminary hearing Wednesday, Municipal Court Judge Wade Weatherford III ruled police had probable cause to issue an arrest warrant.

Defense Attorney Tom Shealy argued that the only evidence Wood was involved was the statement of the victim. He further argued that it would have been impossible for Wood to have been the shooter based on the victim's claims that the shooter, who used a long gun, was seated in a parked vehicle.

While police recovered two shotgun shells from the roadway, they did not recover the gun and did not test Wood for gunshot residue, Shealy added.

Gaffney police said the victim identified Wood as the shooter three times the night of the incident and that Cherokee County sheriff's deputies later found Wood at his home. The same color Cadillac described by the victim was in Wood's driveway, police said.

Following the shooting, the woman drove her car to the front entrance of the Walgreen's pharmacy, where police and paramedics converged.
