Father of dead child sues man whose truck hit her

The estate of an eightyear old girl who was struck and killed by an offduty police officer's vehicle has filed a lawsuit in Cherokee County Court of Common Pleas.

Robert Moore, as personal representative of the estate of his daughter, Peechis Moore, is seeking unspecified damages from David Alton Parker for the wrongful death of the young girl.

Peechis Moore was killed July 6, 2006, while waiting to cross White Plains Road in Cherokee County.

Parker, the former police chief of Jonesville, was driving that day in his 2005 Dodge Truck and was headed south on White Plains Road when he struck her.

Parker, 37, pleaded no contest in Cherokee County General Sessions Court last week to a charge of involuntary manslaughter and was sentenced to five years of probation including one year of home confinement and 120 hours of community service.

Parker maintained he did nothing criminally wrong, though his lawyer conceded that accident investigators determined he was driving over the 55-mph speed limit.

The lawsuit against Parker alleges he was negligent in operating at an excessive rate of speed for the prevailing circumstances, in failing to maintain proper lookout, in failing to keep his vehicle under control, in failing to use due care for the safety of himself and others, and in failing to stop, slow down or take evasive action to avoid striking the young girl.

Robert Moore is represented by Attorney Rodney Richey of Greenville.
