Suit filed after accident
The estate of an Old Georgia Highway man killed in a March 2008 accident filed suit in Cherokee County Court of Common Pleas against the man’s brother.
On March 7, 2008, James Carroll Peterson, was assisting Lowell Lee Peterson, his brother, in attaching a low-boy trailer to a Kenworth truck.
The lawsuit alleges James Peterson was between the truck and trailer when Lowell Peterson backed up, pinning James Peterson between them. Peterson subsequently died from closed chest trauma, according to the lawsuit.
The lawsuit alleges Lowell Peterson was negligent in failing to keep a proper lookout, and in failing to make sure James Peterson was out of harm’s way.
The lawsuit, filed by Attorney Wes Kissinger of Harrison, White, Smith & Coggins in Spartanburg, seeks damages under the Wrongful Death Act and the Survival Act.
