Couple files lawsuit against Pottery Barn

An Oconee County couple has filed suit in Cherokee County Court of Common Pleas against the owner of Pottery Barn in the wake of a 2008 slip and fall accident inside the store at Prime Outlets — Gaffney.

The suit claims Jean Simmons was in the Pottery Barn store Jan. 13, 2008, when she slipped, tripped and fell while walking down an aisle in the store as a result of shelves that negligently were placed near steps.

Simmons landed on her right side, resulting in injuries to her right shoulder, lower back and lower extremity. The lawsuit claims the injuries resulted in $49,000 in past and present medical expenses, pain and suffering, mental and emotional pain, humiliation and loss of enjoyment of life.

Her husband, Douglas Simmons, seeks damages for loss of consortium.

The lawsuit claims the store was negligent in failing to remedy an unreasonably dangerous condition, in failing to warn of the dangerous area, in failing to inspect the premises, and in failing to maintain the entrances, walkways and aisles of the store.

Named as defendant is Williams-Sonoma Stores Inc., a corporation doing business as Pottery Barn.
