TO ALL THE DEFENDANTS ABOVE-NAMED:
YOU ARE HEREBY SUMMONED and required to appear and defend by answering the Complaint in this action, of which a copy is herewith served upon you, and to serve a copy of your Answer on the subscribers at their offices, 2712 Middleburg Drive, Suite 200, Columbia, Post Office Box 2065, Columbia, South Carolina, 29202-2065, within thirty (30) days after the service hereof, exclusive of the day of such service; except that the United States of America, if named, shall have sixty (60) days to answer after the service hereof, exclusive of the day of such service; and if you fail to do so, judgment by default will be rendered against you for the relief demanded in the Complaint.

YOU WILL PLEASE TAKE NOTICE that the Summons and Complaint, of which the foregoing is a copy of the Summons, were filed with the Clerk of Court for Cherokee County, South Carolina on November 4, 2024.
PLEASE TAKE NOTICE that the order appointing Ian C. Gohean, whose address is 325 Rocky Slope Road, Suite 201, Greenville, SC 29607, as Guardian Ad Litem Nisi for all persons whomsoever herein collectively designated as Rachel Roe, defendants herein whose names and addresses are unknown, including any thereof who may be minors, incapacitated, or under other legal disability, whether residents or non-residents of South Carolina; for all named Defendants, addresses unknown, who may be infants, incapacitated, or under a legal disability; for any unknown heirs-at-law of MaryEllen Pleva a/k/a Mary Ellen Pleva, including their heirs, personal representatives, successors and assigns, and all other persons entitled to claim through them; and for all other unknown persons with any right, title, or interest in and to the real estate that is the subject of this foreclosure action, was filed in the Office of the Clerk of Court for Cherokee County on the 25th day of April, 2025.
YOU WILL FURTHER TAKE NOTICE that unless the said Defendants, or someone in their behalf or in behalf of any of them, shall within thirty (30) days after service of notice of this order upon them by publication, exclusive of the day of such service, procure to be appointed for them, or any of them, a Guardian Ad Litem to represent them or any of them for the purposes of this action, the Plaintiff will apply for an order making the appointment of said Guardian Ad Litem Nisi absolute.
AMENDED LIS PENDENS
NOTICE IS HEREBY GIVEN that an action has been commenced by the Plaintiff above named against the Defendant(s) above named for the foreclosure of a certain mortgage given by Stephen F. Pleva and MaryEllen Pleva to Wells Fargo Bank, N.A., dated September 22, 2006, recorded September 25, 2006, in the Office of the Clerk of Court/Register of Deeds for Cherokee County, in Book 1238 at Page 131; thereafter, said Mortgage was assigned to NewRez LLC dba Shellpoint Mortgage Servicing by assignment instrument dated July 9, 2024 and recorded July 12, 2024 in Book 174 at Page 526. The Note and Mortgage were subsequently modified by a Loan Modification Agreement effective July 10, 2020.
The description of the premises is as follows:
All that certain piece, parcel, or lot of land, with all improvements constructed thereon, lying and being in the State of South Carolina, County of Cherokee, approximately two miles north of the Town of Gaffney, on the northwest side of the National Highway, being shown and delineated as Lots 15, 16, 17, 18, 19 and 20 of Block C, on plat prepared for C.L. Chandler by John L. Stacy, dated April 1923, and recorded in the Office of the Clerk of Court for Cherokee County in Plat Book U at Page 718. Reference to the aforesaid plat is made in aid of further description.
Plaintiff has contemporaneously filed a Complaint herein, which includes a cause of action to reform the legal description of the mortgage to be as follows:
All that certain piece, parcel, or lot of land, with all improvements constructed thereon, lying and being in the State of South Carolina, County of Cherokee, approximately two miles north of the Town of Gaffney, on the northwest side of the National Highway, being shown and delineated as Lots 15, 16, 17, 18, 19 and 20 of Block C, on plat prepared for C.L. Chandler by John L. Stacy, dated April 1923, and recorded in the Office of the Clerk of Court for Cherokee County in Plat Book U at Page 718. Reference to the aforesaid plat is made in aid of further description.
ALSO:
All that certain piece, parcel or lot of land, with all improvements thereon or to be constructed thereon, lying and being situate in the State of South Carolina, County of Cherokee, being shown and delineated as Tract B, containing 3166 Sq. Ft., more or less, on plat prepared for Stephen F. Pleva and MaryEllen Pleva by Mike W. Byars and Associates, Surveyor, dated October 1, 2009, and recorded in the Office of the Clerk of Court for Cherokee County in Volume 32 at Page 162. Reference to the aforesaid plat is made in aid of further description.
LESS AND EXCEPT:
All that certain piece, parcel or lot of land, with all improvements thereon or to be constructed thereon, lying and being situate in the State of South Carolina, County of Cherokee, being shown and delineated as Tract A, containing 596 Sq. Ft., more or less, on plat prepared for Stephen F. Pleva and MaryEllen Pleva by Mike W. Byars and Associates, Surveyor, dated October 1, 2009, and recorded in the Office of the Clerk of Court for Cherokee County in Volume 32 at Page 162. Reference to the aforesaid plat is made in aid of further description.
This being a portion of the same property conveyed to Stephen F. Pleva and MaryEllen Pleva by deed of Chris H. Thomas dated September 22, 2006 and recorded September 25, 2006 in Book 253 at Page 262 in the Office of the Clerk of Court/Register of Deeds for Cherokee County, and by deed of Bertha M. Phillips, Pamela Diane Allen, and Cris Ann Thomas, dated November 17, 2009 and recorded November 19, 2009 in the Office of the Clerk of Court/Register of Deeds for Cherokee County.
Subsequently, Steve Pleva a/k/a Stephen F. Pleva a/k/a Stephen Francis Pleva died intestate on or about March 12, 2020, leaving the subject property to his heir, namely Jaclyn Marie Pleva a/k/a Jacqueline Pleva a/k/a Jaclyn M. Pleva, as shown in Probate Case No. 2021-ES-11-00332. Thereafter, Jaclyn Marie Pleva a/k/a Jacqueline Pleva a/k/a Jaclyn M. Pleva was appointed as Personal Representative of the Estate of Steve Pleva a/k/a Stephen F. Pleva a/k/a Stephen Francis Pleva (Probate Case No. 2021-ES-11-00332). Subsequently, MaryEllen Pleva a/k/a Mary Ellen Pleva died intestate on or about February 13, 2024, leaving the subject property to her heir, namely Deborah McCue.
