NOTICE IS HEREBY GIVEN THAT an action has been commenced and is now pending or is about to be commenced in the Circuit Court upon the complaint of the above named Plaintiff against the above named Defendant for the purpose of foreclosing a certain mortgage of real estate heretofore given by Mark P. Cudd and Sandra C. Cudd to U.S. Bank National Association not in its individual capacity but solely as Indenture Trustee for the CIM Trust 2020-R6 bearing date of September 19, 2006 and recorded September 20, 2006 in Mortgage Book 1237 at Page 89 in the Register of Mesne Conveyances/Register of Deeds/Clerk of Court for Cherokee County, in the original principal sum of Forty-Seven Thousand Eight Hundred Twenty and 08/100 Dollars ($47,820.08). Thereafter, by assignment recorded on December 12, 2016 in Book 90 at Page 1201, the mortgage was assigned to CitiFinancial Servicing LLC; thereafter, by assignment recorded on December 12, 2016 in Book 90 at Page 1202, the mortgage was assigned to Bayview Loan Servicing, LLC; thereafter, by assignment recorded on October 16, 2018 in Book 107 at Page 1028, the mortgage was assigned to J.P. Morgan Mortgage Acquisition Corp.; thereafter, by assignment recorded on December 30, 2020 in Book 129 at Page 2426, the mortgage was assigned to CIM Trust 2020-R6.
Thereafter, the Mortgage was assigned to U.S. Bank National Association not in its individual capacity but solely as Indenture Trustee for the CIM Trust 2020-R6, which assignment is to be recorded in said ROD Office., and that the premises effected by said mortgage and by the foreclosure thereof are situated in the County of Cherokee, State of South Carolina, and is described as follows: All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Cherokee, being known and designated as Tract 4B, having 2.23 acres, more or less, as shown on plat prepared by Mike W. This matter comes before the Court on Plaintiff’s Motion to Appoint Guardian Ad Litem Nisi and for an Order for Service by Publication, through which Plaintiff seeks to appoint Kelley Y.
